Quoted from Emery Cleaves' work (1889, p. 3):
"John Emery sen., son of John and Agnes Emery of Ramsey, Hants, England, was horn in England Sept. 29, 1597 ; he sailed from Southampton April 8, 1635, with his brother Anthony in the ship James of London, William Cooper, Captain, their wives and one or two children each probably with them ; he landed in Boston June 3, 1635, and came soon after to Newbury where John, sen., had a town grant of half an acre for a house lot. John Emery was fined Dec. 22, 1637, by the town, twenty shillings for inclosing ground not laid out or owned by the town, contrary to a town order, and on Feb. 1, 1638, the town granted him that part of ground which was already enclosed. He was made freeman June 2, 1641, and recorded as one of the ninety-one freeholders of the town Dec. 2, 1642 ; in the same year he was appointed with three others to make a valuation of all the property in the town, for the purpose of proportioning each man's share in the new divison. On March 16, 1663, John Emery was presented to the Court at Ipswich by Henry Jacques Constable of Newbury, for entertaining of travellers and quakers. May 5, 1663, his presentment for entertaining quakers was referred unto next Court. The next Court fined him four pounds, costs and fees for entertaining strangers. The evidence given in the case was "yt two men quakers wr entertained very kindly to bed and table & John Emmerie shok ym by ye hand and bid ym welcome." Also "that the witness heard John Emery and his wife say that he had entertained quakers and that he would not put them from his house and used argument for the lawfulness of it." John Emery in May, 1663, petitioned the General Court for the remission of his fine. His petition was signed by the selectmen of the town and fifty of the citizens. The fine was not remitted. He was also prominent in the case of Liet. Rohert Pike, refusing to recognize the authority of the Court to deprive him and his neighbors of the right of petition. In the famous ecclesiastical difficulties John Emery was a member of the Woodman party. April 10, 1644, he had a grant from the town of twenty-two acres and five rods being his own and Henry Palmer s portion of Divident land in the great field beyond the new town. He was selectman, 1661 ; fence viewer, 1666; grand juryman in the same year; jury of tryals in 1672; apointed to carry votes to Salem in 1676."

Notes: Marriage
There are differences in view about the date of the marriage of Mary Shatswell and John Emery. Hoyt, in Old Families of Salisbury and Amesbury, p. 152, reports it as October 29, 1650, and this is reported, as well, in the Newbury VRs. Davis notes, however, that John's daughter Ebenezer, born September 16, 1748, was referenced in the will of Mary to the effect that to her daughter Ebenezer would go "the rest of my wearinge cloths." As a result, Davis interprets the 1650 recorded marriage as that of Mary's daughter Mary, from her first marriage, to John Emery, son of Mary's second husband by his first wife. He believes that the 'town copy' made by Henry Short in 1690 mistakenly added that the Mary of this marriage was the widow of John Emery. It is to be noted, however, that Torrey ("The American Genealogist," C. A. Torrey, 17:96-99, 1940-41). The information presented here follows Davis's interpretation.
General Notes: Child - Ebenezer Emery
There is disagreement about whether Ebenezer was the daughter of Mary or of John's first wife Alice. Hoyt, p. 153, has her as the daughter of Alice (though her name is not mentioned) and Davis, p. 525, has her as the daughter of Mary. It is here recorded as presented by Davis, this principally because Ebenezer was mentioned as a daughter in Mary's 1693 will.

General Notes: Wife - Mary Webster
There is disagreement about whether or not this Mary Webster married John Emery, Jr. Torrey ("The American Genealogist," C. A. Torrey, 17:96-99, 1940-41.) makes a case that she didn't. Two key points are (1) that the Newbury VRs have recorded that the Mary Webster who married John Emery in 1650 was the former Mary Shatswell who married John Emery Sr. and (2) that Mary very likely had died young because she was not mentioned in her mothers will of April 1, 1693. Hoyt, p. 152, also reports the 1650 marriage to be that of the former Mary Shatswell and John Emery, Sr.
Walter Goodwin Davis initially (1939) has that Mary Shatswell Webster married John Emery, Sr., in 1648, this because John, Sr.'s daughter Ebenezer was mentioned in Mary's will as her daughter. He believes that the 'widow of John' entry for the 1650 marriage was a mistaken addition on the part of the individual who made the town copies of the early births in 1690, and that that marriage was actually to Mary Webster and John Emery, Jr. Certainly the two of them knew each other well. It is true that Mary Webster was not mentioned in the interpretable parts of her mother's will of 1693. However much of that will is illegible, so it is not clear what the absence means.
Hoyt, p. 152, also reports the 1650 marriage to be that of the former Mary Shatswell and John Emery, Sr. and also that John Emery, Jr. married, in 1648, Mary Webster.
Later (1947) Davis lists John Emery, Jr. with a wife Mary, but provides no family birth name. He also makes no reference to his earlier publication, having dropped most of what is described above without comment.
What is reported here follows Davis' initial presentation, but it must be recognized that it is not at all clear that Mary Webster was the Mary who married John Emery, jr. Torrey's argument is plausible, but the best that can be said for it is that the records are ambiguous, not that there is proof that Mary Webster did not marry John Emery. By the same token, the ambiguity itself is testimony to the fact that we really can't be certain who the wife of John Emery was beyond the fact that her given name was Mary.

From The Revised Genealogical Records of the Descendants of John Emery, p. 22, 23:
"...graduated Harvard College, 1691. He went to Wells, Me. previous to 1698, probably as chaplin to the garrison stationed there. In the town records of 1698, he is mentioned as a minister of the town. 3-17-1701, the town voted to settle Mr. Emery as their regular minister and "to give him yearly 45 pounds to be paid one half in good merchatable provisions as follows: wheat at five schillings a bushel; Indian corn at three schillings a bushel; rye at three schillings a bushel, pork at three pence a pound; beef at two pence a pound and to cut and bring to his house twenty-five cord of firewood and that he should have use of the ministrial land." A church was organized 10-27-1701. Mr. Emery was ordained 10-29-1701, the churches of Newbury, Dover, Portsmouth and York being invited to assist. In 1716, the people being poor in consequence of the war, Mr. Emery relinquished all that was due, being a large part of the amount allowed him as salary. After this his people raised his salary to eighty pounds and directed all mill rents to be paid to him and built a study for his use. The latter part of his life was disturbed by some troublesome matters. He was charitable and of a quiet temperment, performing his duty without ostentation, with zeal and courage fullfilling in an eminent degree the apostolic precept, "as much as in you lieth live peaceable with all men."
