(a) . . . The elder Robert did homage, 19 June 1245, and had livery of
the lands of Roger fitz Payn, his father, and he again did homage, as one
of the heirs of Alvred de Lincoln, 11 July 1264, when he had livery of
the manor and advowson of Winterbourne (St. Martin), Dorset, 3 knights'
fees and 1/5 and 1/2 of a knight's fee, as his purparty of the lands of
the said Alvred; on 28 January 1277/8 he had livery of a moiety of the
lands of his aunt, Aubrey, sister of the same Alvred. His father, Roger
fitz Payn, died shortly before 14 October 1237, when (and 18 October)
Roger's widow, Margery, had livery of her dower; she, who was living 25
July 1245, was sister of the said Alvred, and 1st daughter of another
Alvred de Lincoln, by Maud, his wife. Roger was son and heir of Robert
fitz Payn, who, with his sons, Roger and Robert, had a safe conduct, 11
September 1215.

Robert Fitz-Pain, who, doing his homage in the 30th Henry III [1246], had
livery of his lands in the counties of Wilts, Somerset, and Dorset, and
Netherwent, in Wales. In the 41st of the same reign [1257], he had two
military summonses to march against the Welsh, but after this he appears
to have joined the barons and to have taken a prominent part in the
battle of Leweswhere the baronial banner waved in triumph. He died in
1280, and was succeeded by his son, Robert Fitz-Payne.

SIR ROBERT FITZPAYN, of Llanvair Discoed in Nether Gwent, Okeford
Fitzpaine, Chelborough, Worth, and Wraxall, Dorset, Staple Fitzpaine,
Cheddon Fitzpaine, Cary Fitzpaine, and Bridghampton, Somerset, Poole
Keynes and Stourton, Wilts, &c., son and heir of Sir Robert FiTZPAYN, of
the same (who died shortly before 27 April 1281) (a), by Roberge, his
wife. In July 1277 he proffered service---himself and three others---pro
patre suo infirmo ut dicit, against Llewelyn. He was aged 26 and more, or
27, at his father's death. The King took his homage, and he had livery of
his father's lands, 27 May 1281. He was with the King in the Army of
Wales in 1282, at the battle of Falkirk, 22 July 1298, and in the Army of
Scotland in 1300, 1303, and 1306, being at the siege of Carlaverock in
July 1300, and Marshal of the King's Army citra mare Scocle in 1303. He
was summoned for Military Service from 24 May 1282 to 30 June 1314, to
attend the King at Salisbury, 26 January 1296/7, to attend the
Coronation., 18 January 1307/8, to a Council, 8 January 1308/9, and to
Parliament from 6 February 1298/9 to 24 October 1314, by writs directed
Roberto filio Pagani, whereby,he is held to have become LORD FITZPAYN.As
Robertus filius Pagani dominus de Launver, he took part in the Barons'
Letter to the Pope, 12 February 1300 /1. He was appointed Constable of
Corfe Castle, 20 March 1304/5, during pleasure.
He married Isabel, sister and coheirof Sir Richard DE CLIFFORD, and
daughter of Sir John DE CLIFFORD, both of Frampton-on-Severn, co.
Gloucester. In 1305 John de Maundeville granted the manor of Marshwood
and the hundred of Whitchurch, Dorset, to him and Isabel his wife, and
his heirs. On 12 March 1307/8 the King granted him the custody of the
manors of Stogursey and Rodway, and the hundred of Cannington, Somerset,
then in the King's hand. He was Constable of Winchester Castle, 16 March
1307/8 to 15 May 1314. Steward of the King's Household, 11 March 1307/8
to 14 December 1310. He was sent, with Otes de Graunson and others, on a
mission to the Pope, in March 1308 /9. On 9 February 1309/10 the King
granted him the manor of Norton St. Walery, Hants, for life, but on 16
September 1312 gave him, in its stead, the manor of Kingsbury and the
hundred of Horethorne, &c., Somerset, also for life. He was appointed
Keeper of the Forest South of Trent, 7 December 1311, during pleasure. In
May 1313 he accompanied the King to France. He died 22 August 1315. On 18
October 1315 his widow had livery of the manors which she and her husband
had held jointly, her fealty being respited. Shewas living in 13I9.

Reginald de Dunstanville, 3rd of the fourteen illegitimate sons of King Henry I by the dau. of Robert Corbet, was made Earl of Cornwall by King Stephen, anno 1140. Notwithstanding which, he subsequently espoused the cause of the Empress Maud and was in rebellion until the fall of Stephen's power at the battle of Lincoln. From which period we find nothing remarkable of him until the 10th Henry II [1164], when he appears to have been an unsuccessful mediator between that monarch and the haughty prelate, Thomas à Becket. His lordship was afterward in arms on the side of the king against Robert, Earl of Leicester (who had reared the standard of revolt in favour of Prince Henry, the king's son), and joined Richard de Luci, justice of England, in the siege of Leicester; the town of which they carried, but no the castle. His lordship m. Beatrice, dau. of William FitzRichard, a potent man of Cornwall, and d. in 1175 when, leaving no legitimate male issue, the Earldom of Cornwall reverted to the crown and was retained by King Henry II for the use of John, his younger son, excepting a small proportion which devolved upon the deceased lord's daus., viz., Hawyse, m. to Richard de Redvers; Maud, m. to Robert, Earl of Mellent; Ursula, m. to Walter de Dunstanville; Sarah, m. to the Viscount of Limoges; and Reginald de Dunstanville, d. 1175. Besides his legitimate daus. above-mentioned, the earl left by Beatrice de Vaux, lady of Torre and Karswell, two bastard sons, Henry and William, whereof the elder, Henry, surnamed FitzCount, became a person of great celebrity. Rainald is well known as the Earl of Cornwall, called also Rainald de Dunstanville, perhaps indicating the place of his birth. He helped to foment trouble against Stephen in Normandy, then headed a successful rising in the West Country in support of Matilda and was rewarded by her with his earldom in 1141. Rainald had married a wealthy heiress, Beatrice, daughter of William FitzRichard, 'a man of large estates in Cornwall.' It was not Henry I's policy to establish his bastards on large estates belonging to the crown; rather he used his powers of wardship and marriage to marry them off well. Most of Robert of Gloucester's great domain came to him through his wife and, although Rainald did not marry until five years after Henry's death, he was following a pattern which was well established. Thanks to the conditions of the Anarchy and his support for Matilda and then Henry II, a precedent was set that Rainald had direct control of the country and did not account for it to the exchequer. Much as Henry II must have disliked the condition he no doubt felt it unwise to strip a firm ally of considerable powers, and it was not until Rainald died in 1175, without a male heir, that the king again gained control of the revenues of the county, the earldom reverting to the crown. BARONY OF FITZWALTER
I. 1. SIR ROBERT FITZ WALTER, of Woodharn Walter, Burnham, Roydon, Dunmow, Henham, Wimbish, and Tey, Essex, Shimpling, Suffolk, Diss and Hempnall, Norfolk, son and heir of Sir Walter FITZ ROBERT, of the same (who died shortly before 10 April 1258), by Ida, daughter of [---]. He was born at Henham in 1247, proved his age in 1268, and was knighted in 1274. On 4 July 1275 he had licence to sell Baynard's Castle to the Archbishop of Canterbury. He was in the Army of Wales in 1277 and 1282. He was present in Parliament, at Westminster, at Michaelmas 1278, when Alexander, King of Scots, did homage to Edward I, and proffered his fealty. In February 1280/1 he was about to go to Santiago. On Tuesday in Whitsun week [15 May] 1285 he did homage to the King for his lands in Menelly, Trefrew, and St. Ewe, Cornwall, for which he had previously done homage to Edmund, Earl of Cornwall, which homage the Earl had quitclaimed to the King: he had had livery of these lands, 10 May 1285. He accompanied the King to France in May 1286. He had licence to enfeoff the Earl of Cornwall of all his lands in Devon, 9 February 1289/90. He was appointed Constable of Bere Castle, co. Merioneth, 28 June 1293, and was Constable of Hadleigh Castle, Essex, in July following. Being about to go to Gascony on the King's service, he had licence, 24 August 1294, to let to farm, for two years, the manors of Diss, Hempnall, Sheering, Shimpling, Tey, Lexden, &c., and, 13 October 1295, licence to enfeoff Richard de Hiwisshc of lands, 11 knights' fees, and the advowson of St. Ewe, Cornwall. He was in Gascony in 1296 and 1297, and was at the battle of Falkirk, 22 July 1298. He was appointed Captain and Keeper of the peace in Essex, 12 April 1299. He was at the siege of Carlaverock in July 1300, and on the King's service in Scotland in 1303 and 1306. He was summoned for Military Service from 12 December 1276 to 1 May 1325, to the Coronation, 18 January 1307/8, to Councils from 8 January 1308/9 to 20 February 1324/5, and to Parliament from 4 June 1295 to 10 October 1325, by writs directed Roberto fillo Walteri, whereby he is held to have become LORD FITZWALTER. As Robertus filius Walteri dominus de Wodeham, he took part in the Barons' Letter to the Pope, 12 February 1300/1. On 9 October 1306 he had a pardon for all debts to the King. In April 1310 he was about to go to Jerusalem, with Alice, his wife, and was again going on pilgrimage beyond seas in February 1316/7. On 1 March 1317/8, before going beyond seas, he had licence to demise at farm, for five years, his manors of Burnham, Woodham, Roydon, Henham, and Tey, to whomsoever he wished. In June 1320 he was about to go beyond seas with the King, and, 6 August 1320, was exempted from further military service. On 17 January 1325/6, the day before his death, he had licence to enfeoff Robert, his son, of the manors of Lexden and Roydon. He married, 1stly, Dervorgville, 1st daughter and coheir of Sir John DE BURGH, of Wakerley, Northhants, Portslade, Sussex, Walkern, Herts, &c., by Cecily, daughter, and in her issue coheir, of Sir John DE BALLIOL, King of Scotland [1292-6], of Barnard Castle, co. Durham, and Bywell, Northumberland. On 25 May 1280 the King took his homage, and he and his wife had livery of her purparty of her father's lands, viz., the manor of Hallingbury and Lexden, Essex, and Walkern, Herts. She, who was aged 24 or 25 in 1280, died in 1284, and was buried in Dunmow Priory. He married, 2ndly, in 1289, in the King's Chapel at Westminster, Alianore daughter of Sir Robert DE FERRERS, of Chartley, co. Stafford, sometime Earl OF DERBY, by his 2nd wife, Alianore, daughter of Sir Humphrey DE BOHUN of Kimbolton, Hunts, Walden and Debden, Essex, &c. By charter, dated at Westminster, Thursday the Feast of the Purification 2 February 1289/90, he released to the King lands and rents, worth Ð200 a year, in Burnham and Roydon, and, 11 March following, the King granted the premises to him and Alianore, his wife, and the heirs of their bodies. Alianore was buried in Dunmow Priory. He married, 3rdly (grant of her marriage, 10 May 1308), Alice, widow of Sir Warin DE ISLE, of Campton, Beds, Nedging, Suffolk, Rampton, co. Cambridge, &c. (who died shortly before 7 December 1296), daughter of Sir Piers de Montfort, of Beaudsert, co. Warwick. On 1 September 1312 he had licence to convey the manor of Little Danmow to himself and Alice, his wife, and the heirs of their bodies, with remainder to his right heirs and, 6 October. 1315, licence to convey the manor of Wimbish in the same terms.
