Marshal of the English Army in France, 1340
Captain of the Scottish Marches 1342
Knighted before 1322, he fought at Boroughbridge, March 16, 1231/32 and
was taken prisoner. He was released from imprisonment in Pevensey Castle
on October 16, 1326 and on April 4, 1327 was made Joint Custodian of the
deposed King Edward II. He was tried by a jury of Knights as an accessory
to the murder of the deposed King as was acquitted.

Thomas, 3rd baron, married 1st, Margaret, daughter of Roger Mortimer,
Earl of March, and 2ndly, Catherine, daughter of Sir John Clyvedon, widow
or Sir Peter le Veel. This lord having adhered to the interest of the
Queen, Mortimer, and PrinceEdward, afterwards the third of that name,
furnished "the only precedent," says Smith, "of a peer being tried by
knights, as the peers would have been both judges and jurors." He first
assumed a mitre for his crest. He was summoned to parliament from 1329 to
1360. He had issue by his 1st wife, besides his heir, three sons, who
d.s.p., and one daughter, Joan, wife of Sir Reginald Cobham; by his 2nd
wife, had had, with three sons, who d.s.p., a 4th, John, ancestor of the
Berkeleys of Beverstone. He died 1361 and was succeeded by his son,
Maurice, 4th baron.
