Birth place could have been Portsmouth, England instead of N.H. The fact he died in England and his children were born in England would suggest this. Randy thinks he was a traveling man, which may well be. The births and deaths of the entire family are questionable at this point. (Dec 1999)
General Notes: Child - William Berry
[BillNichols.FTW]
Henry Berry, son of William reportedly immigrated to America in 1650 to Virginia. There was however a William Berry found in the 1624 census of the Jamestown Colony. William lived in the Virginia Colony 96. Could there be a connection???
A William Berry was one of the men sent to the new Colony of New hampshire by Capt. John Mason in 1631. He signed the Glebe conveyance of land @5 May 1640. On 25 May 1640 he lived in Strawberry Bank, now Hampton, New Hampshire. On 18 May 1642 he became a freeman in Newberry, Massachusetts, he was one of the first settles of Newberry. He became a proprietor on 7 Dec 1642 in Newberry. He received a lot "upon the neck of land on the south side of the Little River at Sandy Beach" on 31 Jan 1648 that included the area where 'Locke's Neck' is located. He was said to be the first settler at Sandy Beach in Rye New Hampshire. He served as a Selectman of Strawberry Bank in 1646 and was the Constable for the lower part of the town. He served on the grand jury that same year.

'Rosswell C. Marston was born at North Yarmouth, Maine, on February 4, 1830, and died on December 12, 1908. His early life was spent in the State of Maine. About the year of 1853 he came to Illinois and soon after he was married to a Miss Mary Berry, who died about 1859, leaving one son, Colby. During this time they lived at Lowell, LaSalle Co., IL. Being a carpenter by trade he was employed at Todd's Mills making flour barrels. After the wife's death he married to Miss Lucinda Berry and moved to the farm now occupied by A.W. Luke, south of Dana. There he lived until 1865, when he bought and moved to the farm near there, where he had since lived until a year ago, when he moved to Dana.
On August 11, 1869, death again visited the home, taking his wife. To this union two children were born, whom are living, they are Herbert D. and Lillian.
On January 21, 1871, he was united in marriage to Miss Alice Jones andn tp their union five children were born. They are Charles R., Lena, Wm J., Edgar S., and Flora M. Ensign. They and their mother and Colby and Herbert D., who reside newt Oregon City, Ore., and Lillian M. White, of Mendota survive him. Obituary copied from news article--no date or name of newspaper -- found in records of Juanita Marston Coons --
'Rosswell C.
He also leaves a brother, Jeremiah, and a sister, Mrs. Dix, of Kansas City; a brother, Hiram, of London Mills, and a half-brother, Fred Chick of Nebraska.

Research of Faith Burks Marston -- sent to Ella L. Coons Hendrickson July 20, 2002:-
'I received Roswell and Mary's marriage record in the mail the other day. Also, the Maine marriage CD was wrong about the year they were married, they were married in 1855 in Biddeford, York county, Maine. The information on the marriage record is very brief.
I got the 1850's census CD in the mail yesterday and I've found quite a bit of information on Mary Berry. Her father's name was Zenes Berry and at the time of the census he was 46. Her mother's name looks like it was Marie, the handwriting of the person who made out the census is kind of hard to read. I'll make a copy of the page and mail it to you. This is the actual page from the microfilm. The page of the census concerning the Berry's was done on Sept. 17, 1850 and according to the census both Mary and Lucinda were born in Maine. Zenes Berry was a Manufactuer and his real estate was valued at $500. In the census Roswell lived with Silas and Kesiah Berry and he was a Laborer.
I was looking over the one with Roswell Marston and he was living with a Silas Berry at the time of the census, so I'm wondering if Silas and Zenes are related somehow and that is how he ended up meeting the two sisters he later married.
After doing some more searching I don't think that Maria was Mary's mother but her stepmother. Maria was married first to Joseph Libb(e)y and their children were very close in age to Zenas' I've also found his name spelled differently in several different places. So after finding that Maria was married before I think that she was Mary and Lucinda's step mother.'

John & Mary had at least 9 children, possibly 12. The order of the Births of these children is different than that given by GDMNH which does not provide their dates of birth.
It is not certain that the John Foss baptised at Paignton is the same John Foss who married Mary Berry.
Plummer, John, "Two John Jacksons from Darmouth, Devon, v144,p33, #5-i for Plummer's explanation as to why he believes this John was related to the Jancson family. Foss, Joseph A., Jr., "Benjamin Foss of Machias, Naine, c. 1741 - 1830, his ancestors and descendants".
General Notes: Wife - Mary Berry
Mary (Berry) Foss who testified with her husband John Foss-1 in 1706/7 as to the last will of Rachel (Berry) Marden, was a sister of Rachel's as well as a near neighbor.
Her birth date is an estimate based on the facts that she was the fourth child, that children were typically born at approximately two-year intervals, and that her marriage year was about 1659.

MARDEN FAMILY GENEALOGY
by Sylvia Fitts Getchel
Pg 11-17
John Marden, prob. b. in England arrived in Portsmouth, N.H., prob. bet. 1658 - 1664. First written rec. of his being in Pts. is 28, May 1664, but he was undoubtedly here for at least some time before that. He m. (prob.c.1666) RACHEL BERRY-2, dau. of William-1 and JANE (_____) BERRY. He was living 1702. His will, 11 Aug. 1698, was proved at the same time as the Nuncupative will of his widow Rachel on 12 Feb. 1706/07. Jan. 2, 1722, they lived at Great island and also at Sandy Beach.
John Marden appears also as a witness in 1666 for Mark Hunking, shipwright, of Little Harbor.
The writer is impressed with the reasons to presume that John Marden was connected with the fishing and maritime interests at the Isles of Shoals, and Great Island. The fishing industry had been established for many years there and John Marden might conceivably have been first a fisherman at the Shoals, and then became a permanent resident of the colony. This is only surmise. At any rate, his first acquaintances, of record, were fishermen.
John Marden was on a Portsmouth Subscription List Mar. 8, 1665/66 for 0.9.0 pounds & again on the same list Mar. 14, 1671 for 0.5.0 pounds, the decrease of four shillings probably indicating that he was married by 1671 and was raising a family. These were subscription lists for the support of the Rev. Joshua Moody who came to Portsmouth in 1658. The list of subscribers taken in 1658 does not include John Marden which could indicate he was not yet in the colony, or that he wasn't of and age to be taxed. Early N.H. records are not complete enough to say that his absence from the 1658 list proves he wasn't yet in Portsmouth, but presumably he arrived sometime between 1658 and 1664.
The Berry's are also in the southeasterly portion of the town and William Berry was the first settler on the land which became Sandy Beach or Rye. So the surmise is that John Marden's swelling was in the southeast part of the town of Portsmouth as its bounds then were. New Castle (including Great Island) was taken from Portsmouth and incorporated May 30, 1693. Rye was separated from New Castle Apr. 30, 1726 and combined with parts of Portsmouth, Hampton, and Greenland to be called the "parish of Rye".
Oct. 2,1666
John Mardon took the oath of fidelities upon ye Election of military officers
June 19,1666
John Marden was granted 1ac of land on Great Island, adjoining an acre that had been granted to J. Moss Mar. 6, 1664.

Feb. 26, 1678/9 (Ministers tax for 1677)
A list of delinquent taxpayers of Great Island, Sandy Beach and Sagamore Creek includes "John Marden".
Aug. 25, 1684
John Marden signed (by mark) a petition against Lt. Gov. Cranfield appearing on a list "from Greenland and Sandy Beach".
Dec. 1688
He appears again on a Rye and Greenland Tax List
Feb 20, 1689/90
The General Petition of Inhabitants to Massachusetts to set up a temporary government was signed by John Marden (by mark) thus "John + Marden".
1692-93
Two petitions for a separate township for New Castle bear his name. The first one says John Marden (with no indication that the signature is by mark) but the second petition has signature thus "John X Marden". If he signed his name to the first of these it is the only case where he did, the numerous other instances above mentioned all having been signed by mark.
1693
Pew occupants, Rye church include John-1 and James-2 Marden.
July 1696
He appears on a list of inhabitants of New Castle.
John Marden was taxed as John Marden in 1690 and as "Sr." in New Castle in 1693.
1696/7
He was Highway Surveyor, and received July 1697 for three days work at Fort William & Mary 0.10.6lbs.
Apr 10, 1697
N.H. War Rolls v4 Pg. 664
These may Certify that John Marden helped Ensign Rendle Clamp the wheels at the fort three days.
John Marden moved form Sandy Beach to Great Island. He owned land in both places, and apparently lived in both places.
Several deeds are on record that help us to determine just where john Marden lived.
1697 - In habitants of New Castle
Land of John Marden runs upon a west & by south and a west southwest line to ye Old fence that was Jerry Walforst and runs northward by that fence over to ye Swamp of Edward
Sept. 7, 1745
John Marden, carpenter of Ports. & William Marden, yeoman of Rye sell to Joseph Newmarch of New Castle a piece of land on Great Island belonging unto our Honored Father.
John Marden late of New Castle deceased & on which he once lived it Lyes on the south side of an acre of Land formerly one Morses Land Westward and then along by the highway aforesaid as far as was possessed by our honored Farther.
A loan from "Richard Wybord of Portsmouth shopkeeper" was secured by this Mort. deed, which, as well as giving us another description of the land of Jahn Marden-1 on Great island, is also our only knowledge of John's grandson Samuel Conner.
These deeds certainly state that at some time John Marden-1 lived on his grant of land at Great Island. Built, according to Rachel Marden's will, they had, also, lived on their land at Sandy Beach (now Rye), the home place which she willed to their son William Marden-2 in 1706/7.

Named in his mo.'s will when he inherited the home place at Sandy Beach (Rye).
Libby/Noyes, p.458
"His mo. gave him a choice, the home and land where his fa. dwelt in his lifetime, or the place at Sandy Beach." John and Mary Foss testified that Rachel "gave the house & Land where her husband John Marden in his lifetime sewlt unto her son William Marden". Wm Wallis testified that "she did give and bequeath unto her son William Marden the place at Sandy beach which was formerly his fathers". The tax lists seem to indicate that John 1 Marden had lived at both Great island & Sandy Beach, and the writer believes that William-2 was given the place at Sandy Beach. Note above that when the land on Great island was sold in 1745 both sons John-2 & William-2 (by mark) signed the deed. They were the only sons of John-1 then living.
April 17, 1719

A deed in the Archives
(indexed as being of William Junior) I believe to be of William 2 Marden (Joiner). He signs himself (by mark) as Willm X Marden, and Dorcas Marden signs away her dower rights so it is presumably the elder William.

Eben Philbrick is to "take ye whole length of ye southerly side & such wedth as shall contain 1ac .. I am the true sole & lawful owner .. In mine own proper right as a good perfect & absolute Estate of Inheritance in fee simple .. Dorcas Mardin ye wife of Wm Mardin do give up .. Right of Dower.
Feb. 27, 1733/4
William sold some more of his thatch ground: "William Mardin , Joyner Parish of Rye. Town of new Castle sell to Joseph Brown of rye land in New Castle .. 1ac thatch gd lies in Sandy Beach Pond so called & is bounded as fol.: E. end upon Ragged neck & ye W. end upon ye parting line in ye middle of said Pond & South upon Eben. Philbrick's thatch gd & N in weadth E. end until ye said Brown have his acre.
Note:
In these deeds Rye is still called a "parish of New Castle". some of the earlier refs. to "New Castle" do not necessarily ref. to Great Island which comprises the present town. When new Castle was set off from Pts. in 1693 it included Odiorne's Pt. and Sandy Beach. so from 1693-1726 refs. to new Castle may ref. to those areas as well as to Great island. rye was made a parish of New Castle in 1726 and was called a "parish" until the Revolution.
Sep. 7 1745
William-2 sold, together with his bro. John-2, land that had been their fa.'s on Great Island.
June 15, 1751
William Marden, Gent. of Rye sold to Jonathan Marden of rye, son, cordwainer, land in Rye (1 1/2 ac) "where his house now stands at NW corner of my land laying by Wm Barrey land.
June 18, 1751
William Marden, Gent. of Rye, to Benjamin Marden, farmer, son, of Rye" land in Rye, farm where I now live, bd'd N. on highway, W. on Wm Berry, S. on Wm Berry, Ely on Jonathan Marden, also Thatch ground at Ragged Neck & "6ac mars behind Pond".
Apr 5, 1754
David sells land to Jonathan that was the "Original rite of my honored father William Mardon lying & adjoining to Thomas Folsom's Lot .. Orig. 412" .. land in Epsom.
1709
William was Constable of new Castle in 1709.
General Notes: Child - John Marden
John Marden-2
He was a mast liner and carpenter, and the founder of the Marden Mast Yard of Portsmouth, N.H. at Puddle Dock.
1708
He is on the New Castle tax list for 0.12.0lbs as "John Mardon".
1722 Deed
James-3-14 which is prob. a deed of land (Marden Mast Yard property) actually purchased by John-2 but recorded years later (1761) by error (?) as purchase of James-3. The Marden Mast Yard came into family ownership in 1722 and was managed until 1821 by three generations of Marden mast liners. The writer believes that John-2 was the purchaser.
Nov 23, 1732
John Marden, carpenter of Pts. sold to John Hardeson all his land in Bar. for 5lbs. John Marden signed the deed (by name) and Alice Marden his wife made her mark.
1745
John-2, together with his bro. William-2 sold land on Great Island that had belonged to their late fa., John Marden-1. The fact that John-2 was named first in the deed, and signed it first (with his name), while William-2 was named second and signed it with a mark is a small factor in the decision to believe John-2 to be older than William-2. William-2, it is true, received the home farm in 1706/7 when their mo.d., but this might very well be because John-2 (as well as James-2) had already left home and was provided for. John-2 was b.c.1671 (i.e. aged 78 in Aug. 1749). James-2 and Thomas-2, the only sons taxed in 1696, were evidently older sons, so there is little room to think of William-2 as being also b. bef. 1671.
General Notes: Child - Elizabeth Marden
Elizabeth & Nathaniel Rand were in court Dec. 1701, for having a baby 4 months after marriage. They had a total of 6 children.
General Notes: Child - Mary Marden
Called Mary Jones when named in her mo.'s will in 1706/7
She may have been the first wife of WILLIAM JONES, fisherman, of Newcastle, who m. (2nd) bef. July 17, 1714, Deborah ( Bickford) Jordan. If Mary was William's 1st wife she was d. bef. 1714. William had 3 known ch.: Jeremiah, William, & Hannah, at least the sons by a 1st wife.
General Notes: Child - James Marden
Mentioned in his fathers will (1698) when he received John Marden's-1 "right in the woods that I bought and paid for". James was a cordwainer and is listed with his fa. as inhabit. of New Castle on tax lists for 1693.
A reliable Rye correspondent believes that James-2 ran the ferry to new Castle where the bridge now is to Wentworth-by-the Sea. no documented evidence of this seen, but his son Stephen had the ferry privilege. See ref. to "James Marden's old Grant" near Odiorne's in 1732/3 deed to Stephen Marden which may place James-2 at the ferry.
Feb. 27, 1695/6
James and Thomas Marden both served on an Inquest Jury, when "William Grills and George Major driven ashore by stress of weather and drowned.
July 1696
He appears on a list of "The Inhabitants of New Castle sworn July 1696". Received a grant of 20ac. of land in new Castle 1698/9, where he had built. His name as "James Mardin" is on the tax list for Sandy Beach 1698. Sandy Beach was then still a part of new Castle.
Feb 25, 1706/7
He witnessed (by mark) the will of Samuel Rand of New Castle. Adm. on the Est. of Samuel Rand was gr. to his widow Susanna Rand, Jul. 1, 1707, and James Marden, of New Castle, yeoman, was one of her bondsmen.
Samuel Rand-2 (Francis-1) was a bro. of John Rand-2 of Oyster River. John-2 was fa. of Nathaniel Rand-3 who m. Elizabeth Marden-2, sister of James Marden-2, so Samuel Rand-2 was an uncle of Nathaniel Rand-3, James Marden's-2 bro.-in-law.
1708
James Marden was taxed, New Castle, for 1.2.0lbs, in the division of taxes "for Constable Goss to Collect".
Parsons Hist. of Rye:
Adds a dau. Abigail to the list of ch. of James Marden-2 and says she m. 1st George Foss & 2nd Nathaniel Drake. The writer has not found any other ref. to support this.
Note;
That Mary Marden (b.1727) dau. of James-3 & Judith Bates) Marden,m. George Foss. Perhaps it should be mentioned that there are many errors on Mardens in Parsons.
